Terms of sale and use of the e-shop
1.1. The terms of use of the e-store (hereinafter "terms") apply to all legal relationships, sales transactions, orders, offers that take place between the user of the e-store (hereinafter the "customer") and the owner of the e-store newrustic.ee (hereinafter the "e-store") as one and only OÜ (hereinafter "online store"), registry code: 12718793 between
1.2. In addition to the terms and conditions, the legal relations arising during the use of the e-shop are regulated by the legislation of the Republic of Estonia.
1.3 The online store may change the conditions at any time. Changes to the terms and conditions will be published on the website newrustic.ee and will take effect immediately after publication. By using the e-shop and placing an order through it, the customer confirms that he has accepted the terms.
2. Prices
2.1 Prices in the e-shop are given in euros (marked with the symbol "€").
2.2 Prices include product shipping costs for shipping within the Republic of Estonia. Outside the Republic of Estonia, the customer pays the shipping cost according to the price list established by Omniva.
2.3 If the Customer orders the product from outside the European Union, the product may be subject to import duties and customs duties, which are paid when the product arrives in the destination country. Such taxes shall be paid by the customer. Tax and customs policies may differ from country to country, therefore the online store recommends that the customer familiarize himself with possible additional taxes before ordering the product.
2.4 The online store can change the prices visible in the online store at any time. All changes will be published on the website newrustic.ee and will take effect from the moment of publication.
2.5 If the customer's order has been submitted before the price change has been published, the price that was valid at the time of the purchase will be applied to the customer.
3. Order submission and payment terms
3.1 To place an order, select a suitable product from the online store and press the "add to cart" button. By pressing the "make a purchase" button, you can view the products in the shopping cart, change the quantities and remove them. The amount of the purchase is also visible on the same page.
3.2 When placing an order, the customer is required to enter his data: name, e-mail address, company (if the invoice is prepared for a company), shipping address and telephone. In addition, delivery notes can be added if desired (e.g. preferred location for Parcel Machine). The customer is obliged to check the payment and delivery information, because the speed and ease of delivery of the product depends on the information provided by the customer.
3.3 It is possible to pay for the product using the bank links in the e-shop ordering environment, the payments of which are mediated by Maksekeskus AS, a credit card or via Paypal. The customer pays 100% for the purchase by confirming the order.
3.4 The contract is concluded from the moment the payment reaches the online store's current account, when the customer sends a payment order confirmed by the bank or a screenshot proving the transaction to the e-mail kristi@newrustic.ee.
4. Product delivery
4.1 The online store delivers the product to the customer by post or parcel machine. The online store notifies the customer by e-mail when the product has been shipped or can be picked up and also sends the package tracking code, if available. 4.2 Product delivery by post usually takes 7-9 days in European countries and up to 21 days elsewhere in the world. Shipping by parcel machine takes 1-3 days. If the product has not arrived by that time, please inform e-mail kristi@newrustic.ee. The online store is not responsible for delays or problems if the delay or problem is caused by the inaccuracy of the data entered by the customer when placing the order.
5. Product return
5.1. According to the Consumer Protection Act of the Republic of Estonia, after receiving the product, the customer has 14 days to familiarize himself with the product. If the customer is not satisfied with the product for any reason, the customer has the right to return the product within 14 days by informing the online store of such a wish at the e-mail address kristi@newrustic.ee.
5.2 The product to be returned must be in the original packaging and with all labels attached to the product. The customer must ensure that the returned product is unused and in the same condition as when it was sent to the customer. Returned products with traces of use are not accepted by the online store and will be returned to the customer.
5.3 If the customer returns the product in accordance with the conditions of clauses 5.1 and 5.2, the online store will return the cost of the product to the customer (shipping costs will be borne by the customer). The cost of the product will be returned to the customer no later than 14 days from the moment the customer has submitted the return request to the online store, provided that the returned product itself reaches the online store within this time (i.e. 14 days).
5.4 If the product has defects, the customer is obliged to contact the online store as soon as possible in order to submit a corresponding statement. The online store will replace the product or, if this is not possible, refund the cost of the product. If the product is defective, the cost of replacing the product will be paid by the online store. Pursuant to the Consumer Protection Act of the Republic of Estonia, the consumer customer has the right to submit claims for 2 years from the date of purchase.
5.5 The online store reserves the right to terminate the contract if the product ordered by the customer cannot be produced or if the product was ordered at the moment when there was a typographical error in the price of the product in the online store. If the contract is terminated, the customer will be notified by e-mail and the customer will be refunded as soon as possible, but no later than 30 days after ordering the product.
6. Use and protection of personal data
6.1 The customer gives his consent to the online store to process his personal data. The data entered by the customer when placing an order is stored by the online store, with the aim of fulfilling the order for the product submitted by the customer and developing the service offered to the customer by the online store.
6.2 Personal data to be registered include data about the customer's order - customer's name, company name (if applicable), address, e-mail address, phone number, used payment method and selected product data (including quantities).
6.3 The online store can transfer the customer's personal data, which are necessary for the delivery of the product, to the company providing the courier service.
6.4 The protection of personal data is ensured by all security measures resulting from the law of the Republic of Estonia. The online store does not transfer registered personal data to third parties, except in the cases prescribed by the law of the Republic of Estonia.
6.5. Ükkomakaks OÜ is the responsible processor of personal data, Ükkomakaks OÜ transfers the personal data necessary for making payments to the authorized processor Maksekeskus AS.
7. Liability and force majeure
7.1 The parties are freed from the fulfillment of the obligations arising from and related to the contract in part or in full if this is prevented by force majeure, whereby the parties are obliged to take all measures to prevent damage to the other party and to ensure the fulfillment of the contract to the greatest extent possible. The occurrence of force majeure must be proven by the party who wants to refer to the mentioned circumstances as a basis to be released from the responsibility arising from the law and/or stipulated in the contract for non-fulfillment or non-fulfilment of the obligations assumed by the contract. For the purposes of the contract, force majeure does not include a change in the economic situation of a party, bad weather conditions, price increase, vacation, bankruptcy, nor a bankruptcy warning or securing a lawsuit.
7.2 Any responsibility of the online store is limited to the cost of the product.
7.3 Links that lead from the online store to other web pages are not under the control of the online store, and the online store is not responsible for any damages that may occur in connection with the use of the corresponding links.
8. Applicable law
8.1 The law of the Republic of Estonia applies to the conditions.
8.2 All disputes between the customer and the online store are resolved through negotiations. If no compromise is reached, the customer has the right to appeal to the Consumer Protection Board or the Harju County Court.
