Terms and Conditions of the Online Store

1.1. These terms and conditions (hereinafter referred to as the "terms") apply to all legal relationships, sales transactions, orders, and offers that occur between the user of the online store (hereinafter referred to as the "customer") and the owner of the online store newrustic.ee (hereinafter referred to as the "online store"), Ükskomakaks OÜ (hereinafter referred to as the "web store"), registration code: 12718793. 1.2. In addition to the terms, the legal relationships arising from the use of the online store are governed by the applicable laws of the Republic of Estonia. 1.3. The web store may change the terms at any time. Any changes to the terms will be published on the website newrustic.ee and will take effect immediately upon publication. By using the online store and placing an order through it, the customer confirms their acceptance of the terms.

2. Prices 2.1. Prices in the online store are quoted in euros (denoted by the symbol "€"). 2.2. Prices include shipping costs within the Republic of Estonia. For orders outside the Republic of Estonia, the customer will be charged according to the shipping rates set by Omniva. 2.3. If the customer orders a product from outside the European Union, import duties and customs fees may apply, which are payable upon the product's arrival in the destination country. Such fees are the responsibility of the customer. Customs and tax policies vary by country, so the web store recommends that the customer familiarize themselves with any additional taxes before placing an order. 2.4. The web store may change the prices displayed in the online store at any time. All changes will be published on the website newrustic.ee and will take effect upon publication. 2.5. If the customer places an order before the price change is published, the price that was valid at the time of purchase will apply.

3. Placing an Order and Payment Terms 3.1. To place an order, select a suitable product from the online store and click the "add to cart" button. By clicking "proceed to checkout," you can view, modify, and remove items in the cart. The total purchase amount is also visible on this page. 3.2. When placing an order, the customer is required to enter their details: name, email address, company (if the invoice is issued to a company), shipping address, and phone number. Additionally, the customer may provide notes regarding delivery (e.g., preferred location for a parcel machine). The customer is responsible for verifying payment and delivery information, as the speed and security of delivery depend on the information provided by the customer. 3.3. Payment for the product can be made using the bank links available in the online store's order environment, processed by Maksekeskus AS, by credit card, or through PayPal. The customer must pay 100% of the order amount when confirming the order. 3.4. The contract is considered concluded once the payment reaches the web store's account, or when the customer sends a bank-confirmed payment order or a screenshot proving the transaction to the email kristi@newrustic.ee.

4. Product Delivery 4.1. The web store delivers the product to the customer by post or parcel machine. The web store will notify the customer via email when the product has been dispatched or is ready for pickup, and will also provide a tracking code if available. 4.2. Delivery by post typically takes 7-9 days within European countries and up to 21 days elsewhere in the world. Delivery by parcel machine takes 1-3 days. If the product has not arrived within this time, please notify us at kristi@newrustic.ee. The web store is not responsible for delays or issues caused by inaccurate information provided by the customer when placing the order.

5. Product Returns 5.1. According to the Consumer Protection Act of the Republic of Estonia, the customer has 14 days after receiving the product to inspect it. If the customer is not satisfied with the product for any reason, they have the right to return the product within 14 days by notifying the web store at kristi@newrustic.ee. 5.2. The returned product must be in its original packaging with all accompanying labels. The customer must ensure that the returned product is unused and in the same condition as it was sent to the customer. The web store will not accept returned products with signs of use and will send them back to the customer. 5.3. If the customer returns the product in accordance with clauses 5.1 and 5.2, the web store will refund the product's cost (shipping costs are the responsibility of the customer). The product cost will be refunded to the customer no later than 14 days after the customer has submitted the return request to the web store, provided that the returned product arrives at the web store within this time (i.e., 14 days). 5.4. If the product is defective, the customer must contact the web store as soon as possible to submit a corresponding claim. The web store will replace the product or, if this is not possible, refund the product's cost. If the product is defective, the web store will cover the costs of exchanging the product. According to the Consumer Protection Act of the Republic of Estonia, the customer has the right to file a claim within 2 years of making the purchase. 5.5. The web store reserves the right to terminate the contract if it is impossible to produce the ordered product or if the product was ordered when there was a typographical error in the product price in the online store. If the contract is terminated, the customer will be notified via email, and the payment will be refunded as soon as possible, but no later than 30 days after the order was placed.

6. Use and Protection of Personal Data 6.1. The customer grants the web store consent to process their personal data. The data entered by the customer when placing an order will be stored by the web store for the purpose of fulfilling the customer’s order and improving the service offered by the web store. 6.2. The personal data recorded includes information about the customer’s order: customer’s name, company name (if applicable), address, email address, phone number, payment method used, and details of the product selected (including quantities). 6.3. The web store may share the customer’s personal data necessary for product delivery with the company providing courier services. 6.4. The protection of personal data is ensured by all security measures required by the laws of the Republic of Estonia. The web store does not share registered personal data with third parties, except in cases prescribed by law. 6.5. Ükskomakaks OÜ is the responsible processor of personal data. Ükskomakaks OÜ will forward the personal data necessary for processing payments to the authorized processor Maksekeskus AS.

7. Liability and Force Majeure 7.1. The parties are released from the performance of their obligations under the contract, in part or in full, if prevented by force majeure. However, the parties are obliged to take all measures to prevent causing harm to the other party and to fulfill the contract to the greatest extent possible. The occurrence of force majeure must be proven by the party wishing to rely on such circumstances as grounds for being released from the liability for non-performance or improper performance of contractual obligations. Force majeure does not include a change in the economic situation of the party, bad weather conditions, price increases, vacations, bankruptcy, or bankruptcy warnings or claims. 7.2. The liability of the web store is limited to the product's price. 7.3. Links that lead from the web store to other websites are not under the control of the web store, and the web store is not responsible for any damages that may arise from the use of such links.

8. Applicable Law 8.1. The terms are governed by the laws of the Republic of Estonia. 8.2. All disputes between the customer and the web store will be resolved through negotiations. If no compromise is reached, the customer has the right to contact the Consumer Protection Board or the Harju County Court.
